Policy - UW-Platteville Sanctions for Copyright Violations

A description of student sanctions for copyright violations.

Students will be afforded the procedural guarantees of due process under Chapter UWS 17 Student Non-Academic Disciplinary Procedures and the right, if requested, to a hearing before a hearing examiner or a hearing committee for alleged violations of computing technology policies.

Note: The network connection of any student accused of copyright infringement through use of the UW-Platteville computing network will be disconnected immediately upon notification to the ITS Help Desk Manager of a suspected violation. The student will receive no advance notification of the disconnection to the network.

First or Level I Offense

A student living on campus will be required to meet with the Resident Director of the student's building; a student living off-campus will meet with the ITS Help Desk Manager. The agenda for the meeting will be:
1. Counseling on copyright policies and laws
2. Signing the Copyright Compliance form and taking all steps indicated on the form, including the verified removal of the copyrighted material(s).

Sanction: The resident student’s in-room connection to the network will not be active for a period of 30 days, which will start upon the date when the ITS Help Desk Manager receives notice from the Resident Director of the student's building that the process has been completed.

Second or Level II Offense

The student will be required to meet with the ITS Help Desk Manager. The agenda for the meeting will be:
1. Counseling on copyright policies and laws.
2. Signing the Copyright Compliance form and taking all steps indicated on the form, including the verified removal of the copyrighted material(s).
3. Assigning the student a writing assignment relevant to the issue of copyright infringement, e.g., the student will review and summarize the key points of the white paper of the American Council of Education “Background Discussion of Copyright Law and Potential Liability for Students Engaged in P2P File Sharing on University Networks.”

Sanction: The resident student’s in-room connection to the network will not be active for a period of sixteen (16) calendar weeks of enrollment at UW-Platteville. The sixteen weeks will start upon the date when the ITS Help Desk Manager receives a satisfactory written report assigned to the student.

Third or Level III Offense

The student will be required to meet with the ITS Help Desk Manager and/or the Dean of Students. The agenda for the meeting will be:
1. Counseling on copyright policies and laws
2. Signing the Copyright Compliance form and taking all steps indicated on the form, including the verified removal of the copyrighted material(s).

Sanction: The student will lose all campus network access for twelve calendar months of enrollment at UW-Platteville and face possible additional sanctions, such as disciplinary probation and/or suspension from UW campuses, as permitted under UWS Chapter 17, Student Non-Academic Disciplinary Procedures.

Violations other than copyright infringement, such as hacking or disruption of services, will warrant stronger sanctions (Level II or Level III) depending on the violation. Student may face individual liability for copyright infringement, or other computing technology violations, in civil and/or criminal proceedings. The University of Wisconsin System and UW-Platteville will not defend a student accused of copyright infringement or other computing technology violations.
